Rent Increases & Renting With Pets – Renter Reform Bill

SHARE POST

Will a landlord be able to increase the rents in the new system?

The Government says it does not support rent controls, but the new Act restricts how landlords can raise rents. Any increases must reflect market prices.

Under the new system, all rent increases must follow a statutory Section 13 process, as amended by the Act. Landlords will be required to use a Government-issued form to serve a Section 13 notice.

The form must be served on the tenant for the increase to take effect. If the tenant agrees, they simply pay the new rent from the next rent date.

If the tenant disputes the increase, they can apply to the First-tier Tribunal before the proposed start date and must notify the landlord. This applies if they believe the rent is above market level.

While the case is with the tribunal, the rent will not increase and will not be backdated. There will be no increase until a decision is made, which may take up to a year due to delays. Any increase can only take effect from the date set by the tribunal.

Renting with pets

Can a landlord reasonably refuse a pet? Landlords must consider pet requests on a case-by-case basis, taking into account the landlord, tenant, and property. Pets cannot be refused without a valid reason.

Any refusal must be explained in writing, with reasons outlined (see our other article for details).

Should a landlord unreasonably refuse, the tenant has the option to refer the matter to the Private Sector Ombudsman or take legal action.

In cases where a pet causes damage, the landlord can use the deposit to cover the repairs. If the deposit doesn’t cover the full cost, the landlord may take the issue to court.

We now have a pet policy specifically for landlords. Contact us on 01273 827090, enquiries@iinsure365.co.uk or click here in order for us to give you full details to cover you in the event a tenant damages the property with a pet.
