Ending Section 21 and Prohibiting Rental Discrimination

This article outlines the new rules banning rental discrimination and abolishing Section 21 evictions.

The Act permanently ends Section 21 “no-fault” evictions. Landlords will no longer be able to remove tenants without a valid reason. This gives renters more security and the ability to challenge poor practice and unfair rent increases.

The Act also removes fixed-term tenancies. These agreements currently bind renters to a property even when it falls below standard and often stop them from moving when life circumstances change.

All tenancies will now be periodic. Tenants can stay in their homes until they decide to leave, giving two months’ notice. Leases lasting more than 21 years will be excluded from the assured tenancy system.

Prohibition of Rental Discrimination

Rental discrimination against families with children and people receiving benefits will be banned. Everyone in the private rental sector is entitled to a safe, decent home, and tenants must be assessed fairly.

Landlords and agents can no longer use terms like “No DSS” in adverts and must consider each application individually. However, they will not be required to break any restrictions in their mortgage agreement or lease. If those documents prohibit tenants with children or benefit recipients, landlords will not be obligated to accept them.

Enforcement and Penalties

Local authorities can issue civil penalties of up to £7,000 for breaches of these rules. In addition, those fined can appeal to the First-tier Tribunal. Furthermore, repeat or ongoing breaches may lead to multiple penalties.

Moreover, the enforcement system will be open to all tenants, who can report breaches to their local authority, take court action, or seek help from the Private Rental Sector Ombudsman and letting-agent redress schemes.
